1. Agreement to terms

By creating an account or using GoCharge, you agree to these Terms of Service (“Terms”) and to our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old to create an account. You represent that you have the legal authority to enter into this agreement, that you will use the service lawfully, and that the information you provide is accurate and current. Our Privacy Policy's children's-privacy section additionally confirms that the service is not directed to users under 13 in the United States (per COPPA) or under 16 in the European Union and United Kingdom (per GDPR).

3. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must verify your email address to sign in. Keep your account information current. You may hold one account per person. Notify us promptly of any unauthorized access at support@letsgocharge.com.

4. The service

GoCharge is an informational service that helps EV drivers see real-time charging-station availability based on data that other drivers publish voluntarily. GoCharge is NOT a charging network. We do NOT operate charging equipment. We do NOT guarantee station availability, the accuracy of wait times, the behavior of other drivers, or the outcome of any charging session. Charging fees, if any, are between you and the station operator.

5. Driver-published status data

When you publish your charging status or estimated time to completion, you warrant that the information is reasonably accurate to the best of your knowledge at the time of publication. You grant GoCharge and other users a non-exclusive, worldwide, royalty-free license to display this data within the service. Your published status is visible to other signed-in users in real time.

6. Waitlist

The GoCharge waitlist (informally called “reservations” in some parts of the product) is a queue-ordering feature. It does NOT reserve, hold, or lock a physical charging stall. Whether a stall is actually available when your turn arrives depends on the behavior of other drivers and factors outside our control. You are responsible for arriving promptly when notified and for acknowledging your turn within the notification window (currently five minutes). Failure to acknowledge may forfeit your position in the queue.

7. Smartcar connection (optional)

If you choose to connect your vehicle through Smartcar, you authorize GoCharge to access the vehicle's charge state, location during active charging, VIN, and related telemetry for the purpose of automatically publishing your charging sessions. You may disconnect the vehicle at any time from your Garage. Disconnection stops future data collection but does not delete historical session records.

8. Community submissions

When you submit stall names, provider identifiers, or similar community content, you warrant that:

  • You have the right to submit the content
  • The content is accurate to the best of your knowledge
  • The content does not infringe any third-party intellectual-property or other rights

You grant GoCharge a worldwide, perpetual, royalty-free, sublicensable license to use, modify, publish, and distribute your submissions as part of the service. GoCharge may edit, reject, or remove any submission at its discretion. Approved submissions are published publicly within the app.

9. Acceptable use

You agree NOT to:

  • Publish false or misleading charging status data
  • Submit abusive, offensive, defamatory, or infringing content in community submissions
  • Attempt to access other users' accounts, data, or vehicles without authorization
  • Scrape, mirror, or systematically extract data from the service
  • Interfere with the service or its security systems (rate limiting, anti-abuse, session controls)
  • Use the service to harass, stalk, threaten, or otherwise harm any person
  • Use automated systems or bots, other than the Smartcar connection we provide
  • Circumvent the waitlist queue or manipulate queue positions

10. Intellectual property

GoCharge, the GoCharge name and logo, the service's original code, content, and design elements are owned by GoCharge. You retain ownership of content you submit, subject to the license granted in Section 8.

11. Termination

You may delete your account at any time [LAWYER TO CONFIRM: account deletion flow — will be via support request until an in-app delete is shipped]. GoCharge may suspend or terminate your access for violation of these Terms, fraudulent activity, or at our reasonable discretion with notice. Upon termination, your right to use the service ends. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE. Wait times, station availability, stall identifiers, and other user-published information may be inaccurate. You rely on the service at your own risk.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOCHARGE AND ITS AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR CHARGING-RELATED COSTS (INCLUDING WASTED TRIPS, DETOURS, MISSED CHARGING OPPORTUNITIES, OR VEHICLE RANGE ANXIETY). Our aggregate liability for any claim is limited to the amount you paid us in the twelve (12) months before the claim — which, for free private-beta users, is zero.

14. Indemnification

You agree to indemnify, defend, and hold GoCharge and its affiliates harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the service, your violation of these Terms, or your violation of any third-party rights (including intellectual-property rights in community submissions).

15. Changes to these terms

We may update these Terms as the service evolves. Material changes trigger a version bump (for example 1.0 → 2.0) and will be communicated by email and/or in-app notice at least 14 days in advance where feasible. The current Version and Last updated date appear at the top of this page. Continued use after the effective date of a material change constitutes acceptance. If you do not agree to the updated Terms, you must stop using the service and may delete your account.

16. Governing law and disputes

These Terms are governed by the laws of [LAWYER TO CONFIRM: governing law — default Delaware, USA], without regard to conflict-of-laws rules. Disputes will be resolved in the state and federal courts located in [LAWYER TO CONFIRM: venue — default New Castle County, Delaware], and you consent to the personal jurisdiction of those courts.

17. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our consent; we may assign in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, constitute the entire agreement between you and GoCharge regarding the service.
